Agreement to Terms

By accessing or using Joga Bonito, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Use of Services

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the services in any way that violates applicable laws
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the services
• Copy, modify, or distribute our content without permission
• Use the services for any commercial purpose without our consent

Health and Safety; Assumption of Risk

IMPORTANT: Please read this section carefully before using any training drills or exercises.

Medical Consultation Required

Before beginning any physical training program or performing any drills available through Joga Bonito, you must:

• Consult with a qualified medical professional to ensure you are physically capable of participating
• Obtain medical clearance if you have any pre-existing health conditions, injuries, or concerns
• Stop immediately and seek medical attention if you experience pain, dizziness, discomfort, or any adverse symptoms

Assumption of Risk

You acknowledge and agree that:

• Football and athletic training activities carry inherent risks of injury, including but not limited to sprains, strains, fractures, concussions, and other serious injuries
• Joga Bonito provides educational content and training suggestions only; we are not providing direct, individualized coaching or medical advice
• You are solely responsible for determining whether any drill, exercise, or training method is appropriate for your fitness level, skill level, and physical condition
• You voluntarily assume all risks associated with using the training content, including the risk of injury or death
• You are responsible for ensuring you have adequate supervision, proper equipment, suitable training facilities, and safe conditions before attempting any physical activity

User Responsibilities

When using our training content, you must:

• Use proper technique and form as demonstrated
• Ensure adequate warm-up and cool-down
• Train in a safe environment with appropriate space and surfaces
• Use suitable equipment in good condition
• Stay properly hydrated
• Have appropriate supervision, especially for youth players
• Modify or skip any exercises that feel unsafe or inappropriate for your abilities
• Comply with all applicable safety rules and regulations

Content Disclaimer

The drills, exercises, and training content available through Joga Bonito:

• Are provided for general educational and informational purposes only
• Are not a substitute for professional coaching, medical advice, or individualized training programs
• May not be suitable for all individuals, fitness levels, or circumstances
• Should be adapted based on individual capabilities and limitations
• Are not guaranteed to achieve any specific results

We strongly recommend that all users, especially youth players, perform activities under the supervision of a qualified coach or trainer.

Release and Waiver

To the fullest extent permitted by law in your jurisdiction, you release, waive, discharge, and covenant not to sue Joga Bonito, its directors, officers, employees, and agents from any and all liability, claims, demands, or causes of action arising from or related to participation in training activities based on our content, any injuries or damages sustained while using our training methods, any equipment failure or facility conditions, and any acts or omissions of other users or third parties.

You agree to indemnify and hold harmless Joga Bonito from any claims brought by third parties (including minors for whom you are responsible) arising from injuries or damages related to use of our training content.

Note for certain jurisdictions: Some jurisdictions (including the UK, EU, Australia, and others) do not permit waivers of liability for negligence causing death or personal injury, fraud, or certain consumer protection rights. In those jurisdictions, this waiver applies only to the extent permitted by law, and does not affect your statutory rights.

Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. If you are using our services on behalf of an organization (such as a club or school), you represent that you have authority to bind that organization to these Terms.

Intellectual Property

The services and all content, features, and functionality (excluding user-generated content) are owned by Joga Bonito and are protected by copyright, trademark, and other intellectual property laws.

Our Content

You may not reproduce, distribute, modify, or create derivative works from our platform content, training materials, or drills without our express written permission.

Your Content

Drills and sessions you create: Any training drills, session plans, or coaching content you create using our platform remain your intellectual property. However, by creating and saving content on our platform, you grant Joga Bonito a non-exclusive, worldwide, royalty-free license to store, edit, and display your content, use aggregate, anonymized data about drill and session usage to improve our services, and display your content (and edited versions of it) to other users.

Player data you record: All player names, statistics, and match data you record are your data and remain under your control. We claim no ownership or rights to this information.

Data Protection and Privacy

Local Data Storage

Player records and personal data you create using our match tracking features are stored locally on your device only. This means:

• Player names, statistics, and match data remain on your device
• We do not collect, process, or store this information on our servers
• You are responsible for backing up this data
• Clearing your browser data will delete locally stored information
• We cannot recover lost local data

Your Responsibilities as Data Controller

When you record player information (names, statistics, etc.), you become a data controller under applicable data protection law in your jurisdiction. You are responsible for:

• Obtaining appropriate consent from players (or parents/guardians for minors)
• Complying with data protection laws including UK GDPR, EU GDPR, CCPA/CPRA, or equivalent laws in your region
• Ensuring you have a lawful basis for processing personal data
• Keeping the data secure on your device
• Complying with data subject rights requests (access, deletion, etc.)
• Not sharing player data without appropriate consent
• Meeting any requirements under children's privacy laws (COPPA in the US, Age Appropriate Design Code in the UK, etc.)

What We Do Collect

We collect limited information necessary to provide our services:

• Account information (email, password hash)
• Subscription and payment information (processed by Stripe)
• Usage analytics to improve our services
• Technical information (IP address, browser type, device information)

Data Security

While we implement reasonable security measures for data we control, you acknowledge that:

• No internet transmission is completely secure
• You are responsible for maintaining your account security
• You should use strong passwords and enable two-factor authentication where available
• You are responsible for securing any data stored locally on your devices

Your Rights

Under UK GDPR, you have rights including:

• Access to your personal data
• Correction of inaccurate data
• Deletion of your data (right to be forgotten)
• Restriction of processing
• Data portability
• Objection to processing

Subscriptions and Payments

Some features require a paid subscription. By subscribing, you agree to pay all applicable fees. Subscriptions automatically renew unless cancelled before the renewal date.

Payment Processing: All payment transactions are processed securely through Stripe. We do not store your complete payment card details. By subscribing, you also agree to Stripe's terms of service.

Cancellation: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. We do not provide refunds for partial subscription periods unless required by law.

Price Changes: We may change subscription prices with at least 30 days' notice. Price changes will not affect your current subscription period.

Limitation of Liability

YOU UNDERSTAND AND AGREE THAT:

Exclusions

To the maximum extent permitted by law in your jurisdiction, Joga Bonito shall not be liable for:

• Any personal injury, death, or physical harm arising from your use of training content or participation in physical activities
• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions, errors, or technical failures
• Any damages resulting from your use of or inability to use the services

Mandatory Protections (Cannot Be Excluded)

NOTHING IN THESE TERMS EXCLUDES OR LIMITS OUR LIABILITY FOR:

UK/EU users:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any other liability that cannot be excluded or limited under UK or EU law
• Breach of statutory rights under consumer protection laws

Australian users:

• Rights and remedies under the Australian Consumer Law that cannot be excluded
• Any liability that cannot be excluded under Australian law

US users:

• Gross negligence or willful misconduct (in jurisdictions where applicable)
• Any liability that cannot be excluded under applicable federal or state law

All users: Any liability that cannot be lawfully excluded in your jurisdiction.

Liability Cap

Where we are liable to you and liability is not excluded by mandatory law, our total aggregate liability arising from or related to these Terms or your use of the services shall be limited to the greater of the amounts you have paid us in the 12 months preceding the claim, or £100 (or equivalent in your local currency).

Your Acknowledgment

You acknowledge that the disclaimers and limitations in these Terms are fair and reasonable to the extent permitted in your jurisdiction, and that you would not use the services without these protections in place.

Governing Law and Disputes

Governing Law

UK users: These Terms are governed by the laws of England and Wales.

EU users: These Terms are governed by the laws of England and Wales, without prejudice to your mandatory consumer protection rights under the law of your country of residence.

US users: These Terms are governed by the laws of England and Wales, except where your state law provides greater consumer protections.

Other users: These Terms are governed by the laws of England and Wales, without prejudice to mandatory consumer protection laws in your jurisdiction.

Dispute Resolution

UK/EU users: Any disputes arising from these Terms or your use of our services shall be subject to the jurisdiction of the courts of England and Wales, although you may also bring proceedings in your country of residence if permitted by local law.

Other users: Disputes shall be subject to the jurisdiction of the courts of England and Wales, subject to mandatory dispute resolution mechanisms in your jurisdiction.

Severability

If any provision of these Terms is found to be unenforceable or invalid under the law of your jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the services after changes constitutes acceptance of the new Terms.
